Conflict of Interest - Practice Before Judge/Real

Estate Co-Owner.

The committee has modified its earlier opinion by concluding that the

propriety of members of a law firm appearing before a judge when a member

of the law firm and the judge own real estate as partners, is governed by

the Canons of Judicial Conduct. When the issue before the court involves

the court's personal interest, the judge must disqualify himself unless,

after disclosure on the record, the parties to the proceeding agree that

the judge may continue. [Rules 6: § III(3)(D); cf EC:9-1 and EC:9-2]
