Communicating With One of Adverse Interest.

A staff member/attorney for a governmental agency may communicate with

one who has or later will assert a claim against the agency only according

to the terms of DR:7-103.

 

Also, if the staff member/attorney does not know whether the person is

represented by counsel, the attorney must disclose that he is an attorney

and must inquire whether the person wants legal counsel present. If the

person does not, the attorney then may proceed with the discussion.
