12:30 Lunch Recess
1:15 Thorsen — Does It Send Chills Down Your Spine? (Ethics)
Frank A. Thomas III

To whom do you as a lawyer owe duties? In some cases you may have more clients on a   particular matter than you thought and in others you may have duties to persons who are not your clients. The recent case of Thorsen v. RSPCA addressed some of these issues when it held that a drafting lawyer of a will was liable to a will beneficiary for drafting errors. This presentation will address both the ethical and liability issues of the duties of lawyers to third parties and persons whom the lawyer might not immediately identify as the lawyer’s clients.

2:30 Break
2:40 Lessons from Virginia Fiduciary Litigation Cases
Michael H. Barker, Kristen Frances Hager,
Meghan Gehr Hubbard, Stephen W. Murphy, William I. Sanderson

This session will provide an overview of asset protection planning to fit every estate planning client, from the basics of titling property and accounts, to the treatment of retirement accounts, to the complex rules regarding asset protection trusts. Several recent cases provide a backdrop for understanding how estate plans can be structured, and estates and trusts administered, to protect a client’s assets.
