This two-hour interactive session, taught by the authority on ethics, Tom Spahn, will delve into the critical rules pertaining to conflicts of interest arising in real estate transactions. With the use of hypotheticals, the presentation is fast paced and entertaining as well as enlightening with in-depth analysis of the issues.

I. Commercial: A Practitioner's Guide to the New 2016 ALTA/NSPS Minimum Detail Survey Requirements
James Brown

Participants will learn about the new 2016 ALTA/NSPS Minimum Standard Detail Requirements, including modifications and additions to the surveyor’s responsibilities and changes to the optional Table A Item definitions. The session will be beneficial for those who negotiate and contract with surveyors and for the user of the survey to help alleviate some common misconceptions. A walk-through cursory review of a sample survey will also be included to highlight some of the changes. Upon completion of the session each participant will have a greater understanding of ALTA/NSPS standards, Table A items, survey review, and communicating with surveyors.

II. Residential: Asserting and Defending Claims of Fraud in Residential Transactions
John C. Altmiller

This presentation will address the various issues facing attorneys when potential claims of fraud are asserted in a real estate transaction. Actions for fraud in relation to the sale of real estate have very specific rules regarding liability, the measure of damages, and the effect of the statute of limitations. In the case of real estate agents, understanding the available statutory defenses is critical in prosecuting and defending these claims. For attorneys advising disappointed sellers, or defending sellers and agents accused of fraud, this session will offer a breakdown of the essential legal principles and litigation strategies for handling real estate fraud claims.

This presentation will address common law and statutory rights with respect to surface water and groundwater, how other states are handling those rights from a legislative perspective, and what the future may hold for Virginia in that regard.

Cancellation/transfer requests will be honored through 5:00 p.m. of the DAY BEFORE the seminar.  You will, however, be charged $90 for the materials if you cancel your registration for the seminar, or transfer registration to a different seminar, after the link to the materials has been e-mailed by Virginia CLE®.
