Witnesses win cases. How they conduct themselves at a deposition or trial can profoundly impact the outcome of any case. Those who on direct examination can provide a spellbinding account of a tragic accident, a plain English version of expert testimony, or an unflappable eye witness account will create a natural connection with the trier of fact that will capture their attention from the beginning.

Similarly, as we all know, if direct examination were entirely reliable we never would have invented cross! A witness’ testimony must always be tested for reliability, and great lawyers know just how to do this. And the secret to a great cross may not be what you think it is.

Through the use of a variety of typical case scenarios, this program will provide any attorney who examines witnesses a number of battle-tested techniques to most effectively draw the information from their witnesses on direct examination and to conduct a rapid-fire, no-nonsense cross-examination to expose holes in the testimony of even the most confident and experienced witness. Learn:

  • How to take the triers of fact where you want them to go
  • Asking the right questions, the right way
  • Knowing when enough is enough: How much direct is enough? How much cross is too much?
  • How to make direct examination interesting: avoiding narratives and the dreaded, “So what happened next?”
  • How to succeed when you are making your case entirely through cross-examination
  • How to handle a difficult witness on cross
  • How to examine a hostile or adverse witness
  • Getting comfortable with impeachment
  • Introducing evidence flawlessly
  • Making sure your witnesses are understood
  • How to look like a master when you leave an answer alone on cross and save it for summation

… and lots more!
