When handled correctly, workplace investigations offer employers the chance to limit their vicarious liability for the bad acts of an individual employee, and at the same time lay the foundation for an affirmative defense that is difficult to overcome in employment-related litigation. When handled incorrectly, however, employers run the risk of incurring not only vicarious liability for the bad acts of an individual employee, but also added liability for misconduct during the investigation. This seminar will cover the practical aspects of this important topic. Attendees will learn the legal contours of such investigations, and will gain an appreciation of the dos and don’ts of workplace investigations. The material will be presented from the vantage point of the employee as well the employer.
