COURSE OVERVIEW

For nearly three decades, this annual event has brought together family law attorneys and judges from across the state for an indispensable educational and networking opportunity. As usual, the seminar offers six hours of CLE credit for attorneys, ranging from annual ethics and case law updates to specific programs on the most pressing domestic issues.

Learn how a non-adversarial teamwork approach can assist your clients in making informed choices and can move disputants from positions to interest, goals, and needs. This presentation includes a showing of the Virginia State Bar's Spare the Child video.

This presentation will focus on particular ethical issues confronting lawyers when child custody is at stake. Learn how to ethically balance zealous representation of your client's wishes with the best interests of the child.

2:05 Three (or More) Sides to Every Story: The GAL's Role in Custody Cases and How to Ease the Burden on the Children

This segment will focus on how GALs can advocate for children by steering the parties toward the middle ground in hotly contested cases. When mom, dad, grandparents, (and sometimes DHS and other individuals) have rigid ideas about what is best for the children and none of them seem compatible, the GAL usually can find solutions somewhere in the middle. Convincing one parent that making his/her former spouse disappear is NOT what is best for the children usually is a good place to start. We will also take a look at the role of the GAL in assisting non-traditional families, how GALs can work with mental health providers, and how GALs must avoid giving legal advice to the parents. A quick comment on staying safe and keeping your wits about you will be included.
