• From April 1, 2009, to April 1, 2010, 82 lawyers were publically disciplined
and 41 were privately disciplined in Virginia (up from the prior year). Which
public cases are significant and why?
• Lawyer impairment — how the disciplinary system handles this

FACULTY
Edward L. Davis manages and participates in the work of the Professional
Regulation Department of the Virginia State Bar charged by the Supreme Court of
Virginia with enforcing its disciplinary and unauthorized practice rules. He supervises
a staff of forty lawyers, investigators, and support staff who investigate and
prosecute complaints of unprofessional conduct against lawyers licensed in Virginia.
The staff also gives advice about legal ethics and the unauthorized practice of
law. Mr. Davis reports to the Virginia State Bar’s Executive Director and works
closely with the Standing Committee on Lawyer Discipline, which has oversight
responsibility for the disciplinary system.
Bernard J. DiMuro is the managing partner of the Alexandria law firm of
DiMuroGinsberg, P.C. He represents clients in complex civil litigation and professional
responsibility cases. He was formerly a chairman and member of the Eighth District
Grievance Committee and chairman of the Virginia Supreme Court Disciplinary Board.
Mr. DiMuro also has been a faculty member of the Virginia State Bar Professionalism
Course, a member of the VSB Committee to Study the Code of Professional Responsibility,
and a past president of the VSB. He assists business clients and their general
counsel in litigation management and in the audit of legal fees and legal services.
James M. McCauley is the Ethics Counsel for the Virginia State Bar, and
manages the staff counsel serving the Standing Committee on Legal Ethics, Unauthorized
Practice of Law, and the Standing Committee on Lawyer Advertising and Solicitation.
He and his staff write the draft advisory opinions for the Standing Committees
and provide informal advice over the telephone to members of the bar, bench, and
general public on matters involving legal ethics, lawyer advertising, and the
unauthorized practice of law. Mr. McCauley frequently lectures and publishes articles
on matters relating to legal ethics and the unauthorized practice of law. He teaches
Professional Responsibility at the T.C. Williams School of Law at the University
of Richmond.
REGISTRATION FEE
$139.00 regular registration.
MCLE Credit Caveat: The MCLE Board measures credits by the time you spend
in attendance. If you enter a phone seminar late or leave it early, or both, you
must reflect those adjustments accurately in the credits you report on your credit
reporting form. A code will be given at the end of the seminar, which must
be written on your MCLE form.
Cancellation/transfer
requests will be honored through 2:00 p.m. of the DAY BEFORE the seminar.
