COURSE DESCRIPTION

What will happen to your practice and to your clients in the event of your disability, death, or some sort of disaster? This question is not rhetorical for solo practitioners, who are required to develop a business continuity plan under Virginia’s Rules of Professional Conduct. Attorneys in small and mid-sized firms also would be well advised to make such formal arrangements. This course will explain the ethical requirements and will provide the practical advice that you need in order to devise a business continuity plan for your practice.

In this efficient, two-hour overview, our faculty expert will discuss:
• The ethics rules that apply to business continuity plans and how to comply with these requirements
• Malpractice risks to you (or your estate) when deadlines lapse because you are dead or disabled
• How a good continuity plan will improve the sale value of your practice
• Updates on the relevant emerging trends in malpractice insurance coverage and claims, along with appropriate risk management practices
• Sale of practice regulations in the context of a business continuity plan
• Sample continuity plans for both solos and small firms
• How to avoid ethics pitfalls involving client consent requirements and confidentiality issues that are implicated in continuity planning
