Domestic Relations - Conflict of Interest -

Subsequent Adverse Representation.

March 11, 1986

It is improper for an attorney to represent a wife in a divorce action

when the attorney previously represented the wife in securing an interest

in the marital home for her son of a prior marriage, and previously

represented both the husband and wife with regard to other marital

property, absent the husband's informed consent after full and adequate

disclosure. [ DR:4-101(B)(2), DR:5-105(D); LE Op. 672]
