LEO: Conflict of Interest - Domestic Relations  LE Op. 766

Conflict of Interest - Domestic Relations -

Subsequent Representation Adverse

to Former Client.

January 17, 1986

An attorney first represented husband and wife in litigation against the

wife's first husband for support of a child of the first marriage. It is

not improper for the attorney to represent the current husband in divorce

and custody proceedings not involving the child of the first suit,

assuming the attorney did not receive information in the course of the

first litigation which would be a confidence or secret and which would

give the current husband an unfair advantage. [See DR:4-101(B), DR:5-105(

D)]
