LEO: Conflict of Interest - Multiple Clients -  LE Op. 706

Conflict of Interest - Multiple Clients - Subsequent

Clients - Confidences and Secrets.

November 11, 1985

Notwithstanding dissimilarity of the subject matter, simultaneous

representation of adverse clients creates a presumption of adverse effect

on the attorney's absolute duty of loyalty. Therefore, absent consent from

the subject firm's client doctors and client malpractice plaintiff, the

entire firm is disqualified from representing either party in the medical

malpractice action. [See: DR:5-105(C)]
