LEO: Conflict of Interest - Action Against  LE Op. 622

Conflict of Interest - Action Against Former Client.

November 13, 1984

It is not improper for an attorney to represent a creditor in the

collection of a debt against the attorney's former client when the

collection matter does not involve the confidences or secrets of the

former client gained during the course of that representation, and when

the subject matter of the collection case is not substantially related to

the attorney's representation of the former client; the consent of the

former client after full and adequate disclosure would be required for the

attorney to represent the creditor if either of the above conditions

existed. [ DR:4-101 and DR:5-105(D)]
