LEO: Conflict of Interest - Mechanics'  LE Op. 418

Conflict of Interest - Mechanics' Liens.

June 11, 1981

Where there is any actual or potential competition between the claims of

mechanic's lien claimants, representation by a lawyer of all of the

claimants would be improper. However, when there is no competition among

the claims of the claimants, and the sale of the property against which

the liens are being enforced will yield more than enough money to satisfy

all mechanics' liens, it would not be improper for one attorney to

continue to represent all of the claimants. [See II: DR:5-105(C).]
