LEO: Divorce — Conflict of Interest, LE Op. 295
Divorce — Conflict of Interest.
February 17, 1978
It is not improper for an attorney to represent a husband or wife in obtaining a “no-fault” divorce when the attorney has previously represented both parties in the purchase of their home which was taken as tenants by the entirety, so long as the attorney has not acquired any type of special knowledge from the previous real estate transaction. [See II: DR:4-101(B) and DR:5-105(D).]
