Petition to Set Aside Adoption - Representation of Parties by

Attorney - Conflict.

It is not improper for an attorney to represent "C" in a Petition to set

aside the adoption by "B"of the child of "A" and "C" where the attorney is

representing "A" in a divorce proceeding against "B" if the attorney did

not represent any of the parties in the original adoption proceeding and

assuming the child was born out of wedlock or while the mother was married

to "C." [See II: DR:5-105.]
