LEO: Personal Injury - Conflict - Withdrawal  LE Op. 263

Personal Injury - Conflict - Withdrawal from Employment.

June 23, 1975

It is improper for attorney to continue representing plaintiff in a

personal injury action against defendant when, unknown to attorney,

attorney's partner had undertaken representation of the said defendant in

a traffic charge arising out of said accident and had subsequently

withdrawn therefrom upon learning that attorney had been employed to

represent plaintiff, unless both the defendant and plaintiff consent after

full disclosure to continuation by attorney in representing the plaintiff.
