Real Estate - Condemnation - Conflict in Interest.

It is not improper for a law firm which regularly represents the Highway

Department in condemnation proceedings to represent the owner of condemned

land in purchasing new property under the Relocation Assistance Act so

long as negotiations between the Highway Department and the landowner have

been concluded before the landowner requests representation by the firm

and both the landowner and the Highway Department consent to such

representation after full disclosure. [See II: DR:5-105(C).]
